These Terms of Service (“Terms”) govern your relationship with the operator of Mongol Talk — AI Translator (“we”, “us”) regarding the mobile application (“App”) and related cloud translation and voice features (together, the “Service”).
By installing, opening, or using the App, you confirm that you have read and agree to these Terms. If you do not agree, do not use the Service.
When you download or use the App through the Apple App Store, two related but distinct legal relationships apply:
Where both these Terms and Apple’s Standard EULA address matters such as scope of the software licence, prohibition on reverse engineering, or termination of the licence, they should be read together. For commercial terms, fair use, and liability limits specific to translation, voice, and related cloud features of this App, if there is a conflict with only high-level wording in the Standard EULA, these Terms prevail, except where mandatory law says otherwise.
Apple is not a party to these Terms; Apple does not assume obligations under these Terms regarding the content, accuracy, or availability of the Service (except as stated in Apple’s own policies).
In line with the spirit of Apple’s Standard EULA, maintenance, bug fixes, and user support for the Service are provided by the application supplier (us); Apple has no obligation to provide technical support for this App.
The Service offers speech recognition, text translation, text-to-speech, and other features shown in the App. Actual features follow the latest version of the App. The Service relies on third-party cloud APIs and network connectivity; we do not guarantee uninterrupted service, zero latency, or perfect accuracy.
To keep the Service stable, we may collect technical diagnostics that do not include full transcripts or raw audio (for example timing, error codes, and model/mode statistics). Details, retention, and deletion are set out in the Privacy Policy.
Any flags, regional symbols, or similar icons in the App are used only to help you identify languages, regions, display settings, or regional variants of speech or content. They are purely technical and UI aids and do not constitute and must not be read as any statement, endorsement, or opposition regarding any state, government, political entity, territorial claim, nationality, or political position, nor as indicating affiliation with any government or political organisation.
We explicitly state that such displays have no political purpose or meaning. No one may mischaracterise these neutral UI markers as our political stance, or use them as a basis for politically motivated complaints, public pressure, defamation, or coordinated campaigns against us or the app stores. If that occurs, we reserve the right, within applicable law, to clarify the facts, preserve evidence, and file factual explanations with relevant platforms.
You represent that you have the right and capacity to comply with these Terms. If you use the Service on behalf of an organisation, such use remains subject to the personal and non-commercial limits of these Terms unless we agree otherwise in writing.
The Service is intended for personal, non-commercial reasonable use (for example travel, daily communication, learning). You agree not to use the Service as a primary tool for any of the following (examples only, not exhaustive):
To maintain stability, security, and overall user experience, and to control cloud and third-party costs within reasonable bounds, we do not guarantee literally unlimited or wholly unconstrained use for any user. Where permitted by law, we may monitor and adjust usage based on fair use, capacity, and reasonable commercial considerations.
For clarity, rate limits and quotas may be applied using pseudonymous technical identifiers (such as an anonymous authentication user ID) for specific high-cost features (for example speech recognition), in addition to network- or device-level measures.
If we reasonably believe there is abnormal, abusive, or harmful usage (including without limitation excessive automated requests, unreasonable load on systems or APIs, or use inconsistent with the design of the Service), we may take appropriate steps including quotas, rate limits, suspending or restricting features for specific accounts or devices, and in serious cases terminating or refusing service. Where feasible and legally required, we will explain within reasonable bounds via the App, this website, or contact details you provide; in legal, security, or emergency situations we may act first and follow up afterwards.
Any paid plan (including subscriptions and one-off purchases such as “Lifetime Access: Mongol Talk — AI Translator” as shown on the App Store) does not mean absolutely unconditional, unlimited use in a literal sense; the measures above may apply to free and paid users alike. “Lifetime” or “Lifetime Access” means the benefits described in these Terms for so long as we continue to offer the Service in a reasonable commercial manner; it does not guarantee that the company will exist forever or that the product will never be discontinued.
This fair-use section is part of these Terms and should be read together with our Privacy Policy. Nothing in these Terms affects statutory consumer rights under Hong Kong law that cannot be waived or limited by contract.
Paid features (including subscriptions and one-off purchases such as “Lifetime Access: Mongol Talk — AI Translator”) are processed through the Apple App Store and/or Google Play. You agree to comply with each platform’s terms, privacy policy, and payment rules.
Prices, billing cycles, trials (if any), and auto-renewal conditions are as shown on the purchase screen and platform receipts. Price changes for active subscriptions follow platform rules.
What you obtain by paying is a limited, non-transferable, revocable personal licence to use the App and Service under these Terms and platform rules. It is not a sale or transfer of ownership of the App or its source code.
Unless we agree otherwise in writing, all paid plans are for your personal, non-commercial use only. You must not use the Service for commercial operations, fee-charging translation or similar services to third parties, or large-scale automation to support business activity.
Payments made through the App Store or Google Play are subject to that platform’s then-current policies for refund eligibility and process; we cannot directly approve or deny the platform’s refund decisions. If you dispute a charge, check your bill with Apple/Google first; you may contact us at the email below for service-level display or technical issues.
You may stop using the Service at any time and cancel subscriptions as the platform allows. If we reasonably believe you have breached these Terms, fair use, or law/platform rules, we may warn you, restrict features, suspend, or terminate access. We may also modify, suspend, or discontinue all or part of the Service for technical, security, legal, or commercial reasons, with notice on this website where feasible.
Names, logos, layout, and related software of the App (excluding voice and text you supply) are owned by us or our licensors. Without prior written consent, you must not copy, modify, distribute, reverse engineer, or commercially exploit them, except where mandatory law allows.
You retain rights in content you input; you grant us the permissions reasonably necessary to provide the Service (including transmission to third-party cloud services). See the Privacy Policy.
AI-generated translations or speech are for personal non-commercial reference only; you must judge suitability for formal, legal, or professional contexts yourself.
The Service is provided “as is” and “as available”. AI translation and voice technologies are not guaranteed to be perfectly accurate, instantaneous, or uninterrupted. You accept the risk of relying on such outputs. The Service depends on third-party platforms and APIs; within the limits allowed by law, we are not responsible for availability or policy changes by those third parties.
To the maximum extent permitted by law, our total liability for any claim arising from or relating to the Service is capped at the amount you actually paid to us (via the platform) for the Service in the twelve (12) months before the event giving rise to the claim; if you paid nothing in that period, the cap is HK$100. This does not apply to liability for death or personal injury caused by our fraud or gross negligence, or to any liability that cannot lawfully be excluded or limited under Hong Kong law.
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Disputes should first be resolved in good faith; if that fails, the courts of the Hong Kong Special Administrative Region have non-exclusive jurisdiction. If you are a consumer, mandatory rights under the law of your place of residence remain unaffected where they cannot be waived by contract.
We may revise these Terms. The updated text will be posted at this URL with an updated “Last updated” date. Continued use after changes constitutes acceptance unless mandatory law requires express consent. We are not obliged to email or push-notify every change; you should review this page periodically. If a change materially affects your rights, we will provide a prominent notice on this page or in the App where reasonably practicable.

透過 Apple App Store 下載或使用本應用程式時,存在兩層相互關聯但範圍不同之法律關係:
若本條款與 Apple《標準 EULA》就軟件授權範圍、禁止還原工程、終止授權等事項均有規定,兩者應互為補充。就本應用程式所提供之翻譯、語音及相關雲端服務之商業條款、公平使用及責任限制,如與《標準 EULA》中僅屬概括性之描述有不一致,應以本條款為準,惟不得違反適用法律之強行性規定。
Apple 並非本條款之當事方;Apple 不就本服務之內容、準確性或可用性向我們以外之第三方承擔本條款下之義務(Apple 官方政策另有規定者除外)。
依 Apple《標準 EULA》之精神,有關本服務功能之維護、錯誤修正及用戶支援,由應用程式供應商(我們)負責;Apple 無義務就本應用程式提供技術支援。
本服務提供語音辨識、文字翻譯、語音合成及其他於本應用程式內展示之功能。實際功能以應用程式最新版本為準。本服務依賴第三方雲端 API 及網絡連線,我們不保證服務永不中斷、無延遲或絕對準確。
為維持服務穩定性,我們可能收集不含完整轉錄文字與原始音訊內容之技術診斷指標(例如耗時、錯誤碼、模式統計)。相關資料處理細節、保留期限及刪除政策,以 《私隱政策》 為準。
本應用程式介面中如出現任何國旗、地區旗幟、其他地區性或官方性質之符號或圖示(下統稱「符號」),其用途僅限於協助用戶辨識語言、地區、介面顯示設定或語音/內容之地區變體(例如區分不同語言版本或地區版本),屬於純技術性及介面設計上之輔助顯示,並不構成亦不應被理解為我們對任何國家、政府、政治實體、領土主張、民族或公民身份認同、或任何政治立場之表態、背書、支持或反對;亦不代表與任何政府或政治組織有任何關聯。

任何付費方案(包括訂閱及一次性購買,例如 App Store 所展示之「Lifetime Access: Mongol Talk - AI Translator」)均不代表字面意義上「絕對無條件、無任何上限」之使用權;前述措施得同等適用於免費及付費用戶。「終身」或「Lifetime」係指在我們以合理商業方式持續提供本服務之期間內,你享有條款所載之使用權益,並非保證本公司永久存續或產品永不終止。
本公平使用政策為本條款之一部分,並應與我們之《私隱政策》一併閱讀。本條款任何內容均不影響你作為消費者根據香港法律不能透過合約排除或限制之權利。
本服務之付費功能(包括訂閱及一次性購買,例如「Lifetime Access: Mongol Talk - AI Translator」)透過 Apple App Store 及/或 Google Play 處理。你同意遵守該平台之條款、私隱政策及付款規則。
各方案之價格、計費週期、試用(如有)及自動續訂條件,以購買畫面及平台收據所示為準。已生效訂閱之價格調整依平台規則辦理。
你透過付費所取得者,為依本條款及平台規則使用本應用程式及本服務之有限、不可轉讓、可撤銷之個人授權,並非出售或轉讓本應用程式或其源代碼之任何所有權。
除非我們另以書面同意,所有付費方案僅供你作個人、非商業用途。你不得將本服務用於商業營運、向第三方收費之翻譯或同類服務、或大量自動化以支援業務活動。
透過 App Store/Google Play 支付之款項,退款申請、資格及程序一律依該平台當時適用之政策辦理;我們無權直接批准或拒絕平台方之退款決定。若你對收費有疑問,請先向 Apple/Google 查核帳單,並可透過本條款末段之聯絡方式與我們溝通本服務層面之顯示或技術問題。
你可隨時停止使用本服務,並可依平台指示取消訂閱。若我們合理認為你違反本條款、公平使用政策或法律/平台規則,我們得採取警告、限制功能、暫停或終止你對本服務之存取。我們得依技術、安全、法規或商業考量,修改、暫停或終止全部或部分服務,並於本網頁作出公告(在可行範圍內)。
本應用程式之名稱、標識、介面、編排及相關軟件(不包括你自行輸入之語音及文字),其智慧財產權歸我們或合法權利人所有。未經事先書面同意,你不得複製、修改、散布、還原工程或作商業利用,惟適用法律明文允許者除外。
你輸入之內容仍由你保留依法享有之權利;你授予我們為提供本服務所必要之處理權限(包括傳送至第三方雲端服務)。詳見《私隱政策》。
由 AI 產生之翻譯或語音僅供個人非商業情境下參考,你應自行判斷是否適合於正式、法律或專業場景。
本服務依「現狀」及「可得性」提供。AI 翻譯及語音技術不保證完全準確、即時或無中斷。你同意自行判斷依賴該等輸出之風險。本服務依賴第三方平台及 API;該等第三方之可用性或政策變更所引致之影響,於法律允許範圍內我們不負責。
於法律允許之最大範圍內,就本服務引起或與之相關之任何索償,我們之總責任以你於引致該索償之事件發生前十二(12)個月內就本服務已實際支付予我們(經平台)之金額為上限;若該期間內無任何付費,則以港幣一百元(HK$100)為上限。本段不適用於因我們欺詐、嚴重疏忽所致之死亡或人身傷害責任,或香港法律下不能合法排除或限制之責任。
本條款受香港特別行政區法律管轄並依其解釋。因本條款引起之爭議,雙方應先善意協商;協商不成時,雙方同意香港特別行政區法院擁有非專屬司法管轄權。若你身為消費者,於居住地法律賦予你不可透過合約剝奪之權利,該等權利仍受保障。
我們得修訂本條款。修訂後之全文將刊登於本網址並更新「最後更新」日期。你於修訂後仍繼續使用本服務,即視為接受修訂後之條款;若法律要求須取得你明示同意方得生效者,從其規定。我們無義務以電郵或推送另行通知每一次修訂;你應定期查閱本頁。若修訂重大影響你的權利,我們將在合理可行範圍內於本頁或應用程式內作出顯著提示。
